BooleanKit Terms of Service

Welcome to BooleanKit. These Terms of Service ("Terms") govern your access to and use of the BooleanKit website, tools, and services (collectively, the "Service"). By accessing or using the Service, you agree to be bound by these Terms.
BooleanKit is operated by James ("we," "us," or "our") as a sole proprietor based in the United States. If you do not agree to these Terms, do not use the Service.
1. Service Description
BooleanKit provides AI-powered recruiting tools designed to assist with candidate sourcing and recruitment workflows. The Service includes: (a) a free Boolean Search Builder tool; and (b) premium AI-powered tools accessible through credit purchases.
AI-Generated Content Disclosure: The premium tools use artificial intelligence (specifically Anthropic's Claude) to generate outputs. AI-generated content may contain errors, inaccuracies, or biases. You are solely responsible for reviewing, verifying, and validating all AI-generated outputs before use. We do not guarantee the accuracy, completeness, or fitness for purpose of any AI-generated content.
2. Account Registration
To access certain features of the Service, you must create an account. You agree to: (a) provide accurate and complete registration information; (b) maintain the security of your account credentials; (c) promptly update your account information if it changes; and (d) accept responsibility for all activities that occur under your account.
You must be at least 18 years old to use the Service. By creating an account, you represent and warrant that you meet this age requirement.
3. Credits and Payment
Premium tools require credits to use. Credits are purchased as one-time packs or in custom amounts. Each tool displays its credit cost before use. Credits are non-transferable and have no cash value.
All payments are processed securely through Stripe. By making a purchase, you agree to Stripe's terms of service. Prices are displayed in the applicable currency at checkout and include any applicable taxes where required by law.
Credit Expiration: Purchased credits do not expire and remain available in your account until used.
4. Acceptable Use
You agree to use the Service only for lawful purposes and in accordance with these Terms. You shall not: (a) use the Service to violate any applicable laws or regulations, including employment discrimination laws; (b) attempt to circumvent, disable, or interfere with security features of the Service; (c) use automated systems (bots, scrapers) to access the Service without our express written permission; (d) use the Service in any manner that could damage, disable, or impair the Service; (e) upload content that is unlawful, defamatory, or infringes third-party rights; or (f) attempt to gain unauthorized access to any part of the Service.
5. User Content and Data
You may upload content to the Service, including CVs, resumes, and job descriptions ("User Content"). You retain ownership of your User Content. By uploading User Content, you grant us a limited license to process such content solely to provide the Service to you.
Important: If you upload third-party personal data (such as candidate CVs), you represent and warrant that you have the legal authority to do so and that such processing complies with applicable data protection laws. You are solely responsible for ensuring you have appropriate consent or legal basis for processing such data.
AI Training: We do not use your User Content to train our systems. However, our AI provider (Anthropic) may have its own data practices; please review Anthropic's privacy policy for details on their data handling.
6. Intellectual Property
The Service, including its original content, features, and functionality, is owned by us and is protected by copyright, trademark, and other intellectual property laws. Our trademarks and trade dress may not be used without our prior written consent.
Subject to your compliance with these Terms, you are granted a limited, non-exclusive, non-transferable license to access and use the Service for your internal business purposes.
7. Disclaimers
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
We do not warrant that: (a) the Service will be uninterrupted or error-free; (b) AI-generated outputs will be accurate, complete, or suitable for any purpose; (c) the Service will meet your requirements; or (d) any defects will be corrected.
The Service is a tool to assist with recruiting tasks. It is not a substitute for professional judgment. You are solely responsible for all hiring decisions and compliance with employment laws.
8. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR BUSINESS OPPORTUNITIES, ARISING FROM YOUR USE OF THE SERVICE.
Our total liability for any claims arising from or related to these Terms or the Service shall not exceed the greater of: (a) the amount you paid us in the twelve (12) months preceding the claim; or (b) fifty US dollars ($50).
Some jurisdictions do not allow the exclusion of certain warranties or limitation of liability. In such jurisdictions, our liability shall be limited to the maximum extent permitted by law. Nothing in these Terms excludes or limits our liability for death or personal injury caused by negligence, fraud, or any other liability that cannot be excluded by law.
9. Indemnification
You agree to indemnify and hold us harmless from any claims, damages, losses, or expenses (including reasonable legal fees) arising from: (a) your use of the Service; (b) your violation of these Terms; (c) your violation of any third-party rights, including intellectual property or privacy rights; or (d) your User Content.
10. Termination
We may suspend or terminate your access to the Service at any time, with or without cause, with or without notice. Upon termination: (a) your right to use the Service immediately ceases; (b) unused credits will be handled in accordance with our Refund Policy; and (c) provisions of these Terms that by their nature should survive termination shall survive.
You may close your account at any time by contacting us. Account closure does not entitle you to a refund except as provided in our Refund Policy.
11. Modifications to Terms
We reserve the right to modify these Terms at any time. Material changes will be communicated via email or prominent notice on the Service at least 30 days before taking effect. Your continued use of the Service after changes become effective constitutes acceptance of the revised Terms.
12. Governing Law and Disputes
These Terms are governed by the laws of the State of Delaware, United States, without regard to conflict of law principles. Any disputes arising from these Terms or the Service shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association, except that either party may seek injunctive relief in any court of competent jurisdiction.
Class Action Waiver: You agree that any dispute resolution proceedings will be conducted only on an individual basis and not in a class, consolidated, or representative action.
If you are a consumer in the European Union or United Kingdom, you retain your statutory rights under local consumer protection laws, including the right to bring proceedings in your country of residence.
13. General Provisions
Entire Agreement: These Terms, together with our Privacy Policy and Refund Policy, constitute the entire agreement between you and us regarding the Service.
Severability: If any provision of these Terms is found to be unenforceable, the remaining provisions shall continue in full force and effect.
Waiver: Our failure to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision.
Assignment: You may not assign these Terms without our prior written consent. We may assign these Terms without restriction.
