These Terms of Service ("Terms") govern your use of BooleanKit's website and services. By using our services, you agree to these Terms.

1. Services

BooleanKit provides AI-powered recruiting tools including boolean search builders, resume processing, salary benchmarking, and job description generation ("Services").

2. Account Registration

  • You must provide accurate and complete information when creating an account
  • You are responsible for maintaining the security of your account credentials
  • You must be at least 18 years old to use our Services
  • One account per person - multiple accounts are not permitted

3. Credit System

3.1 Purchasing Credits

  • Credits can be purchased through our website via secure payment processing
  • All prices are displayed in your local currency where available
  • Prices are subject to change with notice

3.2 Credit Usage

  • Credits are deducted when you use premium AI-powered tools
  • Credit costs for each tool are displayed before use
  • Credits are non-refundable once used
  • If an AI processing error occurs, credits may be automatically refunded

3.3 Credit Expiration

  • Purchased credits do not expire while your account remains active
  • Free/promotional credits may have expiration dates as specified
  • Credits cannot be transferred between accounts
  • Credits have no cash value and cannot be redeemed for cash

3.4 Refunds

  • Unused credit purchases may be refunded within 14 days of purchase
  • Refunds are processed to the original payment method
  • To request a refund, contact support@booleankit.app
  • We reserve the right to refuse refunds in cases of abuse

4. Acceptable Use

You agree NOT to:

  • Use the Services for any illegal purpose
  • Process data you do not have authorization to use
  • Attempt to bypass rate limits or security measures
  • Reverse engineer or attempt to extract our AI models or algorithms
  • Use automated systems to access the Services (scraping, bots)
  • Resell or redistribute the Services without permission
  • Upload malicious content or attempt to compromise our systems
  • Harass, abuse, or harm others through the Services

5. Your Content

5.1 Ownership

You retain ownership of all content you submit to our Services (resumes, job descriptions, etc.). We do not claim ownership of your content.

5.2 License

By using our Services, you grant us a limited license to process your content solely for the purpose of providing the Services. This license terminates when you stop using the Services.

5.3 Your Responsibilities

You represent and warrant that:

  • You have the right to submit and process all content you provide
  • For candidate data, you have obtained necessary consents or have a lawful basis for processing
  • Your content does not violate any laws or third-party rights

6. Intellectual Property

The Services, including our website, tools, designs, and documentation, are owned by BooleanKit and protected by intellectual property laws. You may not copy, modify, or distribute our Services without permission.

7. Disclaimer of Warranties

THE SERVICES ARE PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND. WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.

AI-generated content (salary data, job descriptions, etc.) is provided for informational purposes only. You should verify important information independently.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, BOOLEANKIT SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR BUSINESS OPPORTUNITIES.

OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM.

9. Indemnification

You agree to indemnify and hold harmless BooleanKit from any claims, damages, or expenses arising from your use of the Services or violation of these Terms.

10. Termination

  • You may close your account at any time
  • We may suspend or terminate accounts that violate these Terms
  • Upon termination, unused credits are forfeited unless otherwise required by law
  • Sections that should survive termination will remain in effect

11. Dispute Resolution

11.1 Governing Law

These Terms are governed by the laws of the State of Delaware, USA, without regard to conflict of law principles.

11.2 Arbitration

Any disputes shall be resolved through binding arbitration under the rules of the American Arbitration Association. Class action lawsuits and class-wide arbitration are not permitted.

11.3 European Users

If you are a consumer in the EEA or UK, you retain rights under local consumer protection laws that cannot be waived by contract. You may also bring claims in your local courts.

12. Changes to Terms

We may modify these Terms at any time. Material changes will be notified via email or prominent notice on our website. Continued use after changes constitutes acceptance.

13. General

  • If any provision is unenforceable, the remaining provisions remain in effect
  • Our failure to enforce a right does not waive that right
  • These Terms constitute the entire agreement between you and BooleanKit
